Terms of Service

These Terms of Service apply to Mile and all Apponance, Inc. apps. App Store installs: Apps installed from the Apple App Store are also subject to Apple's standard Licensed Application End User License Agreement (the "Standard EULA"), available at apple.com/legal/.../stdeula. Where terms conflict for App Store installs, the Standard EULA governs. Mile's referral program terms are in section 10.

This Terms of Service (“Agreement”) is between you and Apponance and governs use of this app made available through the Apple App Store. By installing the Apponance App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the Apponance App.

In order to ensure Apponance provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please use the “Report as offensive” feature found under each post.

1. Parties

This Agreement is between you and Apponance only. Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. Apponance, not Apple, is solely responsible for the Apponance App and its content.

2. Privacy

Apponance may collect and use information about your usage of the Apponance App, including certain types of information from and about your device. Apponance may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the Apponance App.

3. Limited License

Apponance grants you a limited, non-exclusive, non-transferable, revocable license to use the Apponance App for your personal, non-commercial purposes. You may only use the Apponance App on Apple devices that you own or control and as permitted by the App Store Terms of Service.

4. Age Restrictions

By using the Apponance App, you represent and warrant that (a) you are 17 years of age or older and you agree to be bound by this Agreement; (b) if you are under 17 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the Apponance App does not violate any applicable law or regulation. Your access to the Apponance App may be terminated without warning if Apponance believes, in its sole discretion, that you are under the age of 17 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child’s use of the Apponance App, you agree to be bound by this Agreement in respect to your child’s use of the Apponance App.

5. Objectionable Content Policy

Content may not be submitted to Apponance, who will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker.

6. Warranty

Apponance disclaims all warranties about the Apponance App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Apponance, not Apple, shall be solely responsible for such warranty.

7. Maintenance and Support

Apponance does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, Apponance, not Apple, shall be obligated to furnish any such maintenance or support.

8. Product Claims

Apponance, not Apple, is responsible for addressing any claims by you relating to the Apponance App or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the Apponance App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.

9. Third Party Intellectual Property Claims

Apponance shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the Apponance App. To the extent Apponance is required to provide indemnification by applicable law, Apponance, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Apponance App or your use of it infringes any third party intellectual property right.

10. Mile Referral Program

The Mile referral program ("Program") lets an existing Mile user (the "Referrer") invite friends to Mile with a personal invite code. These terms apply to the Program in addition to the rest of this Agreement. Apponance, Inc. runs the Program.

Eligibility

  • An invite code can be redeemed only by a new Mile account, within the first 7 days after the account is created.
  • Each account may redeem one invite code, once. Each device may be used to redeem an invite code only once.
  • You may not refer yourself, including through a second account, a duplicate account, or an account you control for someone else. Referrals between duplicate or related accounts do not qualify.

How a referral qualifies

Redeeming a code does not by itself give either person a reward. A referral qualifies only when the invited friend becomes a paying Mile subscriber within 60 days of redeeming the code:

  • Annual plan or Lifetime purchase: the referral qualifies 60 days after the purchase, provided it has not been refunded by then.
  • Monthly plan: the referral qualifies after the friend has paid for 6 months in a row without the subscription lapsing.

Free trials, promotional or complimentary access, and purchases that are refunded or reversed do not count as payment. A referral that does not qualify within these windows expires.

Referrer reward

  • The Referrer earns US$10 of referral credit for each qualified referral.
  • When the Referrer's credit reaches US$20, we send the full credit balance as an Amazon.com gift card by email to the email address on the Referrer's Mile account, typically within 14 days. Gift cards are U.S. Amazon.com gift cards, redeemable only on www.amazon.com.
  • A Referrer can earn credit for at most 12 qualified referrals in any rolling 12-month period. Referrals beyond that limit earn no credit.

Invited friends

Only the Referrer is rewarded. An invited friend receives no reward, discount or extra Premium time for redeeming a code; by subscribing, they help the friend who invited them earn a reward. The friend pays the normal price of the plan they choose.

Refunds, cancellations and account deletion

  • If the invited friend's purchase is refunded or charged back, or the friend deletes their account, within 30 days after the referral qualifies, the Referrer's credit for that referral is reversed. Reversed credit may reduce the Referrer's balance below zero, in which case it is offset against future credit, and a gift card that has not yet been sent may be canceled.
  • If the Referrer deletes their Mile account, any credit that has not yet been sent as a gift card is forfeited.

Other terms

  • Referral credit is a promotional record only. It has no cash value, cannot be transferred, sold or exchanged, and is not redeemable for cash or for anything other than the gift card described above.
  • We may withhold, cancel or reverse credit and rewards, and may disable invite codes or close Program participation, where we reasonably believe the Program has been abused, including self-referrals, duplicate or fake accounts, spam, or attempts to manipulate purchases or refunds.
  • We may change, suspend or end the Program at any time. Changes do not affect rewards for referrals that qualified before the change takes effect.
  • Referrers are responsible for any taxes on rewards they receive. Void where prohibited by law.
